Action brought by Enacia Helms and her husband against Fox Badger Theatres Corporation to recover damages for injury sustained by Mrs Helms as the result of her falling in defendant's theatre. Plaintiffs alleged in their complaint that defendant failed to have the premises in question as safe as the nature thereof would reasonably permit. Defendant denied such failure and alleged that Mrs. Helms was negligent as to lookout and the manner in which she used the premises. Upon the trial of the issues under the pleadings and evidence the jury returned a special verdict upon which, after denying various motions after verdict, the court entered judgment for plaintiffs' recovery of their damages from the defendant in accordance with the jury's verdict and assessment of damages.
